Bill Summary

This bill requires owners of certain residential rental units to provide for air conditioning or operational air conditioning systems, under certain circumstances. First, the bill requires air conditioning or operational air conditioning systems to be available and the temperature maintained at no more than 80 degrees Fahrenheit in multiple dwelling units that are occupied by or intended to be occupied by a senior citizen or person with a disability between May 16 and September 30 of each year. This requirement would not apply to seasonal rental units or to any health care facility licensed pursuant to P.L.1971, c.136 (C.26:2H-1 et seq.). Additionally, the bill requires the Commissioner of Community Affairs to promulgate standards for air conditioning systems in other dwelling units that have an air conditioning system installed. In those dwelling units the bill requires that, from May 16 to September 30 of each year, the air conditioning system is to be operational and capable of maintaining, in every unit of dwelling space and every habitable room, a temperature of no more than 80 degrees Fahrenheit. The standards promulgated pursuant to the bill would apply to any multiple dwelling unit.

AI Summary

This bill requires owners of certain residential rental units to provide air conditioning or ensure operational air conditioning systems are capable of maintaining a maximum indoor temperature of 80 degrees Fahrenheit during the summer months, specifically from May 16 to September 30 each year. This mandate applies to multiple dwelling units occupied by or intended for senior citizens (defined as individuals 62 years or older) or persons with a disability, and also to any dwelling unit where an air conditioning system is already installed, with the Commissioner of Community Affairs tasked with establishing specific standards for these systems. The bill excludes seasonal rental units, which are defined as rentals for a short term (no more than 125 consecutive days) to individuals with permanent residences elsewhere, and licensed health care facilities from these requirements. The temperature measurement for compliance is to be taken at least one foot away from any surface in the warmest part of the regularly used space within the dwelling.
