This bill amends the Virginia Consumer Protection Act to prohibit the manufacturing, sale, delivery, offering for sale, or use of cosmetic products containing specific intentionally added ingredients, including certain phthalates, formaldehyde, mercury, parabens, and per- and polyfluoroalkyl substances (PFAS), as well as their salts. It also adds a new article to Chapter 52 of Title 59.1 of the Code of Virginia, titled the "Humane and Toxin-Free Cosmetics Act," which defines "cosmetic," "cosmetics manufacturer," and "ingredient" for the purposes of this new regulation. Violations of these provisions are considered prohibited practices under the Virginia Consumer Protection Act, making them subject to its enforcement and penalties, including civil penalties of $5,000 plus $1,000 for each day the violation continues, with proceeds going to the Literary Fund. The bill also clarifies that a person is not in violation if a prohibited ingredient is present as a technically unavoidable trace quantity due to impurities, the manufacturing process, storage, or migration from packaging, provided the product was manufactured to comply with the act.
