Bill Summary

Virginia Land Conservation Foundation. Allows the Virginia Land Conservation Board of Trustees to waive the requirement for a holder of a conservation easement to have such easement jointly held with a public body whenever such holder acquires any interest in land other than a fee simple interest from a grant or transfer from the Virginia Land Conservation Foundation if such holder is accredited by the national Land Trust Accreditation Commission or meets a similar set of standards and practices adopted by the Board of Trustees in favor of the Department of Conservation and Recreation or another public body.

AI Summary

This bill modifies existing law regarding conservation easements, which are legal agreements that restrict the use of land to protect its natural or historical features. Specifically, it exempts real property burdened by a conservation easement with an assessed value under $100,000, held by an accredited land trust, from a requirement that the holder must have had a principal office in the Commonwealth for at least five years or be a long-standing national organization with an office in the Commonwealth. This change means that such a land trust, even if it doesn't meet those specific residency or operational duration requirements, would not be forced to share the easement with another holder that does meet them, provided the easement includes a third-party right of enforcement in favor of the Department or another public body.
