This bill modifies guidelines for student participation in athletic contests and access to school facilities based on biological sex, defining "sex" as male or female determined by reproductive biology and genome at birth, and "athletics" as organized interscholastic sports. It prohibits students from competing in athletic events designated for the biological sex opposite to their own, as indicated on their birth certificate or other government records, unless no corresponding competition for their sex is available, in which case a female student may compete in a male competition. Schools violating these athletic participation rules will lose state aid, and students or their guardians can sue for injunctive relief and attorney fees. Additionally, the bill mandates that public schools provide separate, distinct areas for students based on their biological sex in situations where students may be undressed in front of others, specifically in shower rooms, locker rooms, and restrooms accessible by multiple students, and prohibits students from accessing facilities designated for the opposite biological sex. While students asserting a gender different from their biological sex may be provided alternative accommodations, such as faculty facilities or single-stall restrooms, these alternatives cannot include access to facilities designated for the opposite biological sex, and parental consent is required for minors.
