Bill Summary

AN ACT amending title 18, Arizona Revised Statutes, by adding chapter 8; relating to information technology.

AI Summary

This bill establishes new regulations for "conversational AI services," which are defined as public-facing artificial intelligence programs that primarily simulate human conversation, excluding those for developers, embedded features, narrow topics, business use, or voice assistants. The bill mandates that operators of these services must clearly inform "minor account holders" (individuals under 18 using the service) that they are interacting with AI, either through a constant visible notice or at the start and periodically during sessions. It also prohibits operators from using reward systems to encourage engagement with minors and requires them to implement measures to prevent the AI from generating inappropriate content for minors, such as sexual material, explicit encouragement of sexual conduct, or statements that sexually objectify them. Furthermore, operators must prevent the AI from falsely implying it is human by avoiding claims of sentience, simulating emotional dependence, or engaging in romantic or sexual innuendos with minors. For all users, if the AI could reasonably be mistaken for a human, a clear disclosure that it is artificial intelligence is required. The bill also mandates that operators provide tools for minors and their parents or guardians to manage privacy and account settings, and establish protocols for responding to prompts about suicidal ideation or self-harm by referring users to crisis services. Operators are prohibited from claiming their AI provides professional mental or behavioral healthcare. Violations can result in injunctions and civil penalties, with the Attorney General responsible for enforcement, and the bill clarifies that it does not create a private right of action for individuals to sue.
