This bill amends Arizona law to clarify the conditions under which a "qualified marketplace contractor" is treated as an independent contractor for state and local employment purposes, including unemployment and workers' compensation. A qualified marketplace contractor is defined as someone who agrees with a "qualified marketplace platform" – a digital service like a website or app that connects contractors with clients and only accepts service requests through its digital platform, excluding services like freight transport – to provide services to third parties. For a contractor to be considered independent, their written contract with the platform must stipulate that they are an independent contractor, that their pay is based on their work output, that they can choose their own hours (though specific hours can be agreed upon), that they can work for others, that they cover their own expenses and taxes, and that the contract can be terminated by either party with reasonable notice, or unilaterally by the contractor. The bill also clarifies that these provisions apply to contracts entered into after the bill's effective date and do not prevent other ways of establishing an independent contractor relationship.
