This bill, amending Tennessee Code Annotated, Title 29, Chapter 3, establishes protections for racing facilities and racetracks by prohibiting legal actions, such as those for nuisance or taking, brought by owners of surrounding real property if the racing facility was established before the property owner acquired their land or built within a five-mile radius of the facility. This protection applies even if the facility's operations change, as long as those changes are lawful, and covers claims filed after the bill's effective date, regardless of when the alleged issue occurred. Furthermore, the bill prevents local governments (political subdivisions) from enacting rules that would unfairly restrict or ban the operation of these facilities. Importantly, this bill does not exempt racing facilities from adhering to state or federal environmental or health and safety laws.
