This bill revises the process by which a child can be transferred from youth court to circuit court for prosecution as an adult in Mississippi. Previously, a child as young as thirteen could be transferred, but this bill raises that age to sixteen, meaning a child must be at least sixteen years old to be eligible for transfer to circuit court, unless they are twelve or younger, in which case they are ineligible. For children between thirteen and fifteen, they must have a history of being adjudicated delinquent for three felonies and committed to the state training school at least twice to be considered for transfer. The bill also clarifies that a transfer study is mandatory for any youth under sixteen when a transfer motion is filed, and the circuit court can review transfer decisions.
