Previously, the law restricted retail fireworks sales to specific periods, primarily June 27th to July 5th, and December 28th to January 1st, with additional provisions for out-of-state sales and specific requirements for retailers west of the Missouri River, such as providing information on fireworks use laws and a map of the Black Hills Forest Fire Protection District for sales outside the main July period. The bill also clarifies that these new licenses are in addition to the general license required under § 34-37-2 and maintains that selling fireworks outside these designated periods, or between midnight and 7:00 a.m., is a Class 1 misdemeanor, a serious criminal offense.
