This bill mandates that the Department of Child Safety (DCS) must record by audio or video any interview it conducts with a child during an investigation, unless the recording equipment malfunctions due to no fault of the department or the department unexpectedly lacks the necessary equipment. Importantly, individuals accused of child abuse or neglect cannot use the DCS's failure to record an interview as a reason to object to statements made by the child in court, nor will it prevent those statements from being used if they are otherwise admissible. The bill also clarifies that parents or legal guardians are generally allowed to record conversations with the DCS, except in judicial proceedings. Furthermore, the bill establishes a conditional enactment, meaning these recording requirements will only take effect if federal legislation is enacted by December 31, 2036, that provides grants to states for such interview recordings, and the DCS director must apply for these grants annually until one is awarded.
