This bill, effective October 1, 2026, prohibits healthcare providers from asking minors (individuals under 18, with certain exceptions like emancipation or military service) questions about their gender identity, feelings about their body, or gender confusion unless a parent is physically present, fully informed, and provides written consent, and the questions are directly related to diagnosing or treating a specific medical or psychological condition. It also prevents health insurance issuers and similar entities from requiring providers to ask these questions as a condition of payment or participation, and prohibits them from penalizing providers for not asking them. The bill clarifies that this does not apply to questions about a female's menstrual period, nor does it limit mandated reporting of child abuse or neglect, emergency medical care, or a minor's voluntary reporting of abuse or danger. Parents are also granted full access to any written forms or electronic assessments given to their minor children in healthcare settings, and violations by healthcare providers are considered unprofessional conduct subject to disciplinary action by their licensing boards.
