This bill creates a new felony offense in West Virginia for digitally manipulating sexually explicit content to make it appear that a minor is involved. Specifically, it prohibits anyone from altering a photograph, image, video, movie, or similar recording of sexually explicit conduct by inserting the visual image of an "actual minor" – defined as a person whose image was captured when they were under 18 – to create the false impression that a minor is engaged in that conduct. This new crime is separate from any other existing offenses and carries penalties of a fine up to $10,000, imprisonment for one to five years, or both.
