This bill mandates that health insurance providers, referred to as "health carriers," must include coverage for infertility services in their policies for West Virginia residents. This coverage will encompass the diagnosis of infertility, which is defined as a disease of the reproductive system affecting an individual's ability to conceive or carry a pregnancy to live birth, as well as medically necessary fertility treatments aimed at achieving a live birth. Furthermore, it requires coverage for fertility preservation services, such as egg or sperm freezing, for individuals undergoing medical treatments that could impair their fertility, provided these services are not considered experimental. The bill also prohibits insurance providers from imposing discriminatory limitations on this coverage, such as different deductibles or waiting periods compared to other medical services, and clarifies that it does not cover experimental procedures, non-medical costs related to surrogacy, or reversal of voluntary sterilization. The Insurance Commissioner is tasked with creating rules to implement this article, which will take effect on January 1, 2027.
