This bill amends existing West Virginia law to clarify that individuals holding a lawful medical cannabis card, and their designated caregivers, are not prohibited from owning, purchasing, or possessing firearms solely based on their status as medical cannabis users or caregivers, unless their current or past use of cannabis demonstrably affects their mental, emotional, or physical processes to the point of abnormal behavior. The bill explicitly states that no state or local agency can restrict, revoke, suspend, or otherwise infringe upon a person's right to own, purchase, or possess firearms, ammunition, firearm accessories, or related licenses or certifications simply because they are a medical cannabis cardholder or caregiver. This change is inserted into a section of law that lists individuals prohibited from possessing firearms, specifically addressing unlawful users of controlled substances.
