The bill defines "school" as any elementary or secondary school overseen by a county board of education, and "youth sports league team" as a team belonging to an organization that governs competitive youth sports, excluding teams that are part of or represent schools directly. The new rule will apply to athletic practices or events involving schools, youth sports league teams practicing or playing on school grounds, and events regulated by the West Virginia Secondary School Activities Commission, which is an organization that governs competitive youth sports for schools. The initial rule must align with existing state law regarding concussion management for activities regulated by the West Virginia Secondary School Activities Commission, but the Board of Education or the Board of Physical Therapy can suggest changes to that law if they find better methods for concussion education, prevention, or response. The rule will also specify who needs to receive concussion-related education, and schools will be required to adopt a Concussion Education, Prevention, and Response Plan according to these new rules.
