This bill establishes the "Empire State Sports and Entertainment Fund" to create financial incentives aimed at attracting sports and entertainment events to New York State, with a particular focus on economic development in upstate regions. The fund is designed to make New York venues more competitive in securing events that are not currently scheduled in the state and could reasonably be held elsewhere. To qualify, a "qualifying sports or entertainment event" must not be part of a regular, exclusive schedule at a single venue, must have at least 5,000 ticketed attendees, and must not be contractually obligated to take place elsewhere. Businesses applying to the fund must host such an event, be in compliance with worker protection laws, not owe past-due state taxes, and submit an application at least 90 days before the event, demonstrating its economic benefit and compliance with tax laws. Upon approval, a business receives a "certificate of eligibility" and, after meeting all criteria, a "certificate of funding" specifying the amount and taxable year for the award. The Commissioner of Economic Development is responsible for establishing regulations, determining eligibility, and overseeing the program.
