This bill authorizes the West Virginia Department of Environmental Protection (DEP) to create and implement a legislative rule, specifically identified as 45 CSR 34, which will establish emission standards for hazardous air pollutants, or HAPs. Hazardous air pollutants are a group of air toxics known or suspected to cause cancer or other serious health effects, such as reproductive problems or birth defects, or adverse environmental effects. The DEP is being given the authority to finalize these standards, which were filed in the State Register on July 23, 2025, under the existing legal framework provided by section 22-5-4 of the West Virginia Code.
