This bill allows county boards of education in West Virginia to hire or accept certified chaplains as volunteers to offer support, services, and programs to students, staff, and parents, with the chaplains being selected by and accountable to the school board. Importantly, these chaplains are not required to meet state certification or licensing requirements, and the bill clarifies that this provision does not prevent a school board from having more than one chaplain. Before starting, any hired or volunteer chaplain must undergo a fingerprint-based state and federal background check, and individuals registered or required to register as sex offenders or child predators are prohibited from serving. Furthermore, the bill provides a limitation of liability for chaplains, meaning they generally cannot be sued for actions or statements made while providing services, unless those actions or statements were intentionally malicious, willful, and designed to cause harm, harass, or intimidate.
