This bill amends existing Arizona law regarding accessory dwelling units (ADUs), which are secondary housing units on the same lot as a primary single-family home. The key change is to the requirements for fire sprinklers in ADUs. Previously, municipalities could not require ADUs to have fire sprinklers. This bill now allows municipalities to require ADUs to comply with their residential fire sprinkler ordinances, but only if that ordinance was in place before December 31, 2009, and only to the same extent as other residential units subject to that ordinance. The bill also clarifies that ADUs are generally permitted uses, with specific regulations on their size and placement, and it sets a deadline of January 1, 2025, for municipalities to adopt these regulations, after which ADUs will be allowed without limits if the municipality fails to act. This legislation applies to municipalities with a population over seventy-five thousand.
