This bill allows the Commissioner of Health to petition a circuit court to appoint a receiver for any public or private waterworks that is unable or unwilling to provide adequate and safe service, expanding the current law which only permits this for private waterworks. A receiver is an officer of the court appointed to take control of and operate a waterworks in the best interest of its customers when it fails to supply pure water, has inadequate capacity, the owner has not complied with orders, abandoned the system, is subject to a forfeiture order, or poses an imminent danger to public health and welfare. The court will hold a hearing to determine if a receiver is necessary to protect customers' health and welfare, and the receiver will manage the waterworks until it can be returned to the owner, transferred, or otherwise reconfigured by the court.
