This bill amends the Virginia Residential Landlord and Tenant Act to clarify a tenant's right to prevent eviction by paying all outstanding amounts owed to the landlord. Specifically, if a tenant pays all rent due, authorized late fees, any damages, and court costs before the initial court date for an unlawful detainer (a legal action to evict a tenant), the landlord cannot charge more than $100 for attorney fees, and the eviction case will be dismissed. The bill also clarifies that a tenant can pay these amounts, or a third party can pay on their behalf, at various stages of the eviction process, including up to 48 hours before a scheduled eviction, to cancel the eviction, unless there are other reasons for eviction besides non-payment of rent. Additionally, landlords can limit a tenant's ability to use this "right of redemption" (the right to pay and avoid eviction) to once per rental agreement period, provided they give written notice of this limitation.
