Bill Summary

AN ACT RELATING TO LOCAL GOVERNMENT; PROVIDING A PRIVATE RIGHT OF ACTION FOR INJUNCTIVE RELIEF TO COMPEL A COUNTY OR MUNICIPALITY TO ENFORCE ITS ORDINANCES; REQUIRING WRITTEN NOTICE AND A TIME PERIOD FOR THE COUNTY OR MUNICIPALITY TO ENFORCE THE ORDINANCE.

AI Summary

This bill establishes a process for residents or businesses to compel local governments to enforce their own rules, known as ordinances. If a county or municipality fails to enforce an ordinance, a resident, business, or the state's Attorney General can send a written notice to the local government. The local government then has fourteen days to either enforce the ordinance or explain in writing why they believe it wasn't violated or why it wasn't enforced. If the local government still doesn't act after this notice period, the resident, business, or Attorney General can sue in court to force the county or municipality to enforce the ordinance or to repeal it, and if they win, they can be reimbursed for their legal costs.
