This bill establishes an E-cigarette and E-cigarette Liquid Directory in West Virginia, requiring manufacturers to obtain marketing authorization from the U.S. Food and Drug Administration (FDA) for their products before selling them in the state. Manufacturers must also certify to the State Tax Commissioner and the Alcohol Beverage Control Commissioner that their products meet FDA requirements or were legally marketed before a specific date and have pending applications with the FDA. A $100 fee per product is required annually for inclusion in the directory, which will be maintained and made public by the State Tax Commissioner and Alcohol Beverage Control Commissioner starting September 1, 2026. Selling e-cigarettes or e-liquids not listed in this directory will be prohibited from that date, with penalties for both manufacturers and sellers, and the two commissioners will share joint regulatory enforcement authority.
