This bill allows circuit courts in West Virginia to remove elected officials or appointed officials who are filling an elective office from their positions. This can happen if a petition is filed, signed by registered voters representing 15% of the votes cast in the last election for that office. The grounds for removal include neglecting a clear, mandatory duty of the office, misusing the office, or being incompetent in performing duties, provided these issues significantly harm how the office functions. Additionally, an officer can be removed upon conviction of a misdemeanor, or upon conviction of certain sex offenses like sexual assault, attempted sexual assault, peeping or spying into a dwelling, consensual sexual intercourse with a 15-year-old or older, or indecent exposure, if the conviction materially and adversely affects their ability to perform their duties and all appeals have been exhausted.
