This bill amends existing Kentucky law to clarify the responsibilities of the Cabinet for Health and Family Services (CHFS) regarding state-operated mental health facilities. It replaces the term "institutions" with the more modern term "facilities" throughout the relevant statute. Crucially, the bill establishes that CHFS is responsible for ensuring that patients in these state-operated mental health facilities receive necessary medical care, even if that care must be provided outside of the facility, such as in emergency situations. The bill also specifies that expenses for such outside medical care, unless elective, will be paid by CHFS and considered when determining patient liability, especially if not covered by a patient's insurance. Additionally, the bill updates language related to the care and support provided to individuals with mental illness outside of state facilities, including provisions for community-based programs and case management.
