This bill requires developers of generative artificial intelligence (AI) systems, which are AI systems that create new content based on existing data, to disclose information about the data used to train these systems when they are made publicly available to Washington residents, starting January 1, 2027. Developers must post on their websites a high-level summary of the training data, including its sources, purpose, quantity, types of data, whether it includes copyrighted or personal information, if it was purchased or licensed, and any modifications made. They must also detail steps taken to remove child sexual abuse material. This requirement applies to systems released on or after January 1, 2022, and to substantial modifications of those systems. However, there are exceptions for AI systems solely designed for security and integrity, aircraft operation, or national security/military purposes made available only to federal entities, as well as AI systems regulated under the federal Food, Drug, and Cosmetic Act. The bill also clarifies that developers should comply with generally acknowledged best practices without compromising their intellectual property. Violations of this chapter are considered unfair or deceptive practices under the state's Consumer Protection Act.
