AN ACT Relating to providing an alternative condition for 2 extraordinary medical placement for incarcerated individuals; and 3 reenacting and amending RCW 9.94A.728. 4

AI Summary

This bill amends existing law to create an alternative condition for an incarcerated individual to be granted an "extraordinary medical placement," which allows them to leave a correctional facility. Previously, this placement was only authorized if the individual was deemed to have a permanent or degenerative condition that posed no future public safety threat, or if they were expected to die within six months and also posed no public safety threat. This bill adds a third condition: an incarcerated individual can be eligible if they have a serious medical condition that prevents the department of corrections or its contractors from meeting their "basic medical care needs," which is defined as health accommodations, treatments, prescriptions, or medical devices consistent with the accepted standard of care for healthcare providers in Washington State. To qualify for any extraordinary medical placement, the individual must also be assessed as low risk to the community and the placement must be expected to save the state money. The bill also clarifies that individuals sentenced to death or life without parole are not eligible, and that electronic monitoring is generally required unless it's detrimental to the individual's health.
