This bill amends Arizona law to regulate kratom products, which are derived from the plant *mitragyna speciosa*. It updates the definition of "kratom" and "kratom product" to be more inclusive, and it repeals a previous section related to kratom product regulation. A new section is added requiring kratom products to be labeled with ingredients, the quantity of key compounds like mitragynine and 7-hydroxymitragynine, and recommended serving information, either directly on the package or via a scannable code. The bill also prohibits the sale of kratom products containing more than 400 parts per million of 7-hydroxymitragynine on a dry-weight basis, or any synthetic alkaloids derived from kratom. Furthermore, it raises the minimum age to purchase kratom products from 18 to 21 years old and clarifies that any person, not just processors or retailers, can be held responsible for violations. Violations of labeling requirements are classified as a class 2 misdemeanor, while violations of sales prohibitions are a class 3 misdemeanor, and individuals harmed by violations can pursue private legal action. The bill also includes a defense for sellers who relied in good faith on representations from manufacturers or distributors about the nature of the kratom product.
