This bill prohibits the land application, spreading, sale, and distribution of certain materials derived from wastewater treatment plants, specifically sludge (the semi-solid byproduct of wastewater treatment) and septage (fluid from septic tanks), and compost or other agricultural products made from them, due to concerns about perfluoroalkyl and polyfluoroalkyl substances (PFAS), which are man-made chemicals. However, exceptions exist for disposing of these materials in lined landfills, for agricultural products derived from food waste, crops, or specific food and beverage production processes (like brewing or distilling), and for materials from precipitated calcium carbonate production or animal manure, provided these exempted materials are not mixed with prohibited substances. The bill also directs the Department of Environmental Quality to study and develop a plan to eventually prohibit the land application of septage and requires the Oklahoma Department of Agriculture, Food, and Forestry to create plans for removing, remediating, and recovering PFAS contamination for affected agricultural producers, with reports to be submitted to the legislature.
