This bill requires the State Board of Corrections to create rules for a verification process before a death sentence is carried out, ensuring that the Department of Corrections follows constitutional rules against cruel and unusual punishment, that any medical equipment and drugs used are from reputable sources, that personnel involved understand and are trained in the execution protocol, and that those who wish to opt out of being present are allowed to do so without penalty. The rules must also confirm that the person administering any lethal drugs is properly licensed and has passed a criminal background check, that the victim's immediate family is informed of the execution and their right to witness it, that the list of attendees is accurate, and that a complete audio and visual recording of the execution is made. The Board must prevent an execution if any of these verification criteria are not met, and this act will become effective on November 1, 2026.
