This bill directs the Oklahoma Department of Human Services to request a federal waiver from the United States Department of Agriculture Food and Nutrition Service to prohibit the use of Supplemental Nutrition Assistance Program (SNAP), a federal program providing food assistance to low-income individuals and families, benefits for purchasing candy and soft drinks, and potentially other nonnutritive foods as determined by the Director of Human Services. To obtain this waiver, the Department must provide a justification based on public health concerns, SNAP's intended purpose, and potential cost savings, along with a plan to ensure retailers' systems can enforce the restriction, an outreach strategy for recipients about healthy alternatives, and a method to track the waiver's impact on spending and health. If approved, these restrictions must be implemented within six months, and the Department will be required to submit an annual report to state legislative leaders and the Governor detailing the waiver's status, SNAP spending, and any challenges or recommendations. This act is set to become effective on November 1, 2026.
