This bill authorizes law enforcement officers in Tennessee, who are certified or commissioned by the state, to seize and impound a vehicle if they have probable cause to believe it was used for drag racing, which is an illegal form of racing on public roads. This impoundment is temporary, lasting no more than 72 hours, and during this time, the vehicle's owner or any lienholder must be notified in writing about the reasons for the seizure. The owner has the right to challenge the impoundment through an administrative hearing or by petitioning a general sessions court for a judicial hearing, which must be held within five business days of the request. If probable cause for the seizure is not proven at the hearing, any impoundment fees paid by the owner will be reimbursed, or the vehicle will be returned immediately at no cost. This provision does not prevent further legal action, such as forfeiture of the vehicle, if the owner is convicted of drag racing.
