This bill requires manufacturers of pharmaceutical products, which are defined as drugs or devices including prescription medications, over-the-counter drugs, vaccines, and research products, to publish a complete list of all ingredients, including active and inactive components, biological materials like mRNA and DNA, synthetic materials such as lipids and nanotechnology, and additives. This disclosure must include the chemical and common names, origin of biological materials, purpose, and quantity of each ingredient, and for gene-based products, the sequence and source of nucleic acids and the delivery mechanism. This ingredient information must be submitted to the State Board of Pharmacy, published on the manufacturer's website, and included in product labeling and marketing materials, with this requirement remaining in effect even during declared national emergencies. Noncompliance can result in significant fines, suspension or revocation of the right to sell products in the state, and even criminal charges for repeated or intentional misrepresentation, with individuals harmed by noncompliance having the right to pursue civil lawsuits, including class actions. The bill also establishes protections for whistleblowers who report violations and mandates the creation of a reporting system for complaints, while granting the Legislature exclusive authority to create rules for enforcement and stating that this act will supersede any conflicting laws, with an effective date of January 1, 2027.
