This bill prohibits employers who voluntarily pursue economic development incentives from the state or local government, such as grants, loans, or tax credits, from engaging in certain practices related to labor organizations. Specifically, an employer would be ineligible for these incentives if they voluntarily recognize a union based solely on signed authorization cards instead of a secret ballot election conducted by the National Labor Relations Board (NLRB), voluntarily share an employee's personal contact information with a union without written consent, or sign a neutrality agreement with a union. The bill also prohibits employers from requiring subcontractors to engage in these prohibited activities. If an employer is found to have violated these provisions after receiving an incentive, they will be required to repay all incentives received for the project. However, these restrictions do not apply to employers or subcontractors who do not directly receive economic development incentives, nor do they affect agreements made before the bill's effective date or employers with existing collective bargaining agreements or where a secret ballot election has already occurred. The bill also establishes a process for reporting suspected violations to the Attorney General, who will investigate and determine if a violation has occurred, and sets an effective date of November 1, 2026.
