The bill outlines several exceptions, including price differences based solely on cost variations, publicly disclosed eligibility criteria for discounts (like signing up for a mailing list or participating in a promotional event), discounts for common social groups (teachers, veterans, seniors, students) with clear and accessible terms, loyalty or rewards programs where prices aren't individualized, and discounts allowed under other specific laws. Violators face a civil penalty of up to $3,500 per violation, and the Attorney General can investigate and take action. Importantly, any pre-dispute arbitration agreements or waivers of joint action (like class-action lawsuits) are deemed invalid and unenforceable for actions brought under this bill, overriding federal arbitration laws.
