This bill mandates that parents have full access to their minor child's medical records, including laboratory results, diagnoses, and billing information, regardless of whether they are in paper or electronic format, with "electronic patient portal" referring to any online system used to access health information. Health care providers, defined as entities that create or maintain medical records, are prohibited from requiring a minor child to have a separate electronic portal account from their parent and must grant parents read-only or read-write access equivalent to what the patient would receive until the child turns eighteen, unless specific exceptions apply. These exceptions include records related to services for which minors can legally consent on their own, such as treatment for sexually transmitted infections, substance abuse, or pregnancy-related care, as well as records where disclosure is prohibited by a court order or would pose a substantial risk of harm to the child, provided the provider documents this risk. Providers must grant access within five business days of a request, provide written explanations for any denial citing specific statutory exceptions, and cannot charge a fee for portal access. Failure to comply will be considered an unfair or deceptive practice and a reportable violation to professional licensing boards, with the act taking effect on November 1, 2026.
