This bill allows the Missouri Board of Pharmacy to waive certain state rules for licensed pharmacies in Missouri when they are dispensing, shipping, or delivering prescription drugs into another state or U.S. territory that is experiencing a declared state disaster or emergency. A "declared state disaster or emergency" refers to a situation where a governor has issued a state of emergency proclamation or the U.S. President has declared a major disaster or emergency. The "disaster period" is defined as the time starting ten days before such a proclamation or declaration and lasting for sixty days after it ends, though the governor can extend this period. For the waiver to apply, the Missouri pharmacy must be in good standing, authorized to ship to the affected area, responding to the emergency, complying with the emergency rules of the affected state or territory, adhering to all federal laws, and the waiver must only apply to drugs sent to residents or healthcare facilities within the specified disaster area. The Board of Pharmacy is also authorized to create rules to implement these provisions, which will be subject to standard administrative procedures.
