This bill, known as the Oklahoma PFAS-Safe Biosolids and Farmland Protection Act, establishes regulations for the land application of biosolids and septage, which are treated sewage sludge and human waste respectively, onto agricultural land in Oklahoma. It mandates that before such materials can be applied to farmland, they must be tested for per- and polyfluoroalkyl substances (PFAS), a group of man-made chemicals, using an approved laboratory method. The bill creates a tiered system for managing PFAS levels, with different management requirements based on the concentration of specific PFAS compounds like PFOA and PFOS, ranging from permitted land application with minimal restrictions in Tier 1 to a complete prohibition in Tier 4, requiring alternative disposal methods. Generators of biosolids and septage must report test results to the Department of Environmental Quality and provide them to landowners before application, who must give written consent after reviewing the information. The Department of Environmental Quality is empowered to establish more protective rules, enforce compliance through penalties, and maintain a public database of test results and application locations, with the entire act becoming effective on November 1, 2026.
