This bill, titled the Multifamily Property; Water; Certificate Act, aims to update Arizona's laws regarding water supply assurances for new developments, particularly focusing on multifamily properties and residential lease communities. It requires individuals seeking building permits for six or more detached single-family residences, multifamily residential properties, or condominiums within any active management area (a designated region for water management) to obtain a certificate of assured water supply from the director of water resources, or a written commitment of water service from a designated water provider, unless their application was submitted by September 30, 2024. Additionally, cities, towns, and counties are prohibited from approving such building permits unless this water supply assurance is demonstrated. The bill also introduces new definitions for "condominium" and "multifamily residential property" and expands the scope of "residential lease community" to include six or more detached residential dwelling units offered for lease, regardless of lease term, under a common promotional plan. Furthermore, it mandates that activation fees, which are one-time fees paid to a water replenishment district to help fund water acquisition and infrastructure, will now apply to residential lease communities and condominiums enrolled on or after January 1, 2027, and these fees can be paid in full at the time of permit application. Finally, the bill adjusts how annual membership dues, which are fees paid to water replenishment districts, are calculated and collected, extending them to apply to each residence within a residential lease community or unit within a condominium.
