This bill modifies the definition and requirements for designating "open pasture roads," which are county-maintained roads where the land on both sides is owned or leased by the same party and the roadway is unfenced, allowing livestock to roam freely. Previously, there was a strict deadline of November 1, 2025, for roads to meet these conditions to be designated, but this bill removes that time limitation, granting boards of county commissioners the authority to designate such roads even if conditions change after that date. The bill also clarifies that property owners are responsible for notifying the county commissioners about eligible roads and for the cost of installing "cattle crossing signage," which are diamond-shaped signs with a cow graphic. Importantly, neither the property owner nor the livestock owner will be liable for damages to vehicles or occupants caused by collisions with livestock on these designated roads, and conversely, drivers will be liable for any damage they cause to property. Property owners must annually notify the county commissioners that the road still meets the designation requirements and that they wish for it to remain an open pasture road, or they will have 30 days to fence their livestock out of the roadway. This act is set to become effective on November 1, 2026.
