This bill amends Arizona law to exempt certain electric generating units from the requirement of obtaining a certificate of environmental compatibility, a permit demonstrating that a proposed power plant or transmission line is compatible with the environment, before construction. Specifically, it allows for the construction and operation of thermal or nonthermal electric generating units if the owner has already received such a certificate, which has been approved by the corporation commission, a state agency that regulates utilities. Additionally, the bill modifies the process for utilities to replace existing power plants or construct new ones adjacent to existing facilities, allowing them to bypass the full certificate of environmental compatibility process if they provide 30 days' notice, hold a public comment session, and the new or replacement plant is on or adjacent to a site that previously received a certificate or was in use before August 13, 1971, with the total power output remaining the same or increasing.
