This bill modifies existing law regarding contracts between county and municipal jails and the United States for holding individuals in federal custody. It clarifies that jail officials have the discretion to accept federal detainees if space is available, but any agreement to do so, except in cases with a valid judicial warrant, must be formalized through a contract with the United States *before* the jail accepts any person in federal custody. This contract must stipulate that the United States will cover the total cost of confining or committing the individual, and if these funds are not received by the local county or municipality as agreed, the jail is no longer obligated to hold federal detainees. Furthermore, the bill prohibits counties and municipalities from contracting with the United States to hold individuals who have been transported across state lines, unless a valid judicial warrant has been issued.
