Under current law, an all-terrain vehicle (ATV) operated on a highway must be equipped with the parts, lamps, and other equipment in proper condition and adjustment as required for motor vehicles. In addition, a person operating an ATV on a highway is prohibited from operating the ATV at speeds in excess of 35 miles per hour (MPH). Pursuant to Code section 321.383, when operated on a highway at a speed of 35 MPH or less, any vehicle principally designed for use off the highway is required to be identified with a reflective device in accordance with the standards of the American society of agricultural engineers. This bill specifies that the existing requirements under Code section 321.383 apply to ATVs when operated on a highway. A person who operates a vehicle on a highway without displaying a required slow-moving vehicle reflective device commits a simple misdemeanor punishable by a $45 scheduled fine.
