This bill updates the rules for determining the proper location, or "venue," for legal actions involving trusts in Oklahoma. Previously, such actions could be filed in the county where a trustee resided. Now, the bill specifies that venue is generally proper in the county where the trust's main administration is located or will be located. If the trust was created by a will and the deceased person's estate is still being handled, the action can also be filed in the county where the estate is being administered. The bill also clarifies that if a trust has no trustee, a legal proceeding to appoint one can be filed in a county where a beneficiary lives, where trust property is located, or where the decedent's estate is or was being administered. The bill also makes a technical correction to refer to "the Oklahoma Trust Act" instead of "this act" in a section about civil procedure rules. This bill will become effective on November 1, 2026.
