This bill allows district attorneys, who are the elected officials responsible for prosecuting crimes in a county, to initiate proceedings to adjust the sentences of individuals convicted of crimes at any point after the initial sentencing, as long as the adjustment does not increase the time spent in confinement or the period of supervision for a suspended sentence. Before filing such a motion, the district attorney must make a good-faith effort to consult with the victim or their representative, consider the impact on the victim, and notify them about the motion, the hearing date, and their right to be present and speak. During the hearing, courts can consider postconviction factors such as an inmate's disciplinary and rehabilitation record, evidence of reduced risk due to age, time served, or diminished physical condition, and changes in circumstances since the original sentencing that might make continued incarceration no longer in the best interest of justice. The bill also mandates that inmates receive credit for time already served. However, these sentence adjustment provisions do not apply to sentences of death, life without parole, or offenses requiring registration as a sex offender.
