This bill mandates that the Department of Highways, under the direction of the Department of Environmental Protection (DEP), will dredge and clear waterways throughout West Virginia that the DEP identifies as prone to flooding. The DEP will establish a system to assess waterways, including creeks, rivers, and streams, that are blocked by silt, sediment, and other debris, which reduces their capacity and causes flooding in residential and business areas, or risks damage to infrastructure. Once identified, a plan will be implemented to remove these blockages, which involves dredging and hauling away the material to appropriate sites designated by the DEP. The DEP will also oversee the clearing process to ensure the protection of wildlife and plant life and to prevent pollution from the loosened sediment.
