Bill Summary

AN ACT to amend the executive law, in relation to establishing a persistent domestic violence offender registry

AI Summary

This bill, known as "Savanna's Law," establishes a persistent domestic violence offender registry, which will be accessible to the public online, starting January 1, 2027. The registry will include individuals convicted of domestic violence offenses who have at least one prior conviction for a similar offense. Domestic violence is broadly defined to include various acts under the penal law committed by a family or household member, which encompasses a wide range of relationships including those by blood, marriage, with a child in common, cohabiting, or in an intimate relationship. When a person is convicted of a domestic violence offense and has a prior conviction for such an offense, the court will order them to register. The registry will contain the offender's name, date of birth, conviction details, and a photograph, but will exclude sensitive personal information like their address or social security number. A registration fee of $150 will be assessed, with a portion retained for administrative costs and the remainder sent to the domestic violence awareness fund. An offender will be removed from the registry after a period ranging from five to twenty years, depending on the number of prior convictions. Importantly, victims of domestic violence will have the option to decline having the offender included on the registry.
