This bill amends existing Idaho law to revise the penalties for soliciting commercial sexual activity, which is defined as paying, offering to pay, or agreeing to pay someone for sexual contact, or offering or agreeing to provide someone for sexual contact in exchange for a fee. Specifically, the bill establishes that soliciting commercial sexual activity will be a misdemeanor for individuals aged 18 but under 21, with a second or subsequent conviction becoming a felony; misdemeanor convictions carry a mandatory minimum of five days in jail, up to a year in jail, or a fine of up to $2,000, or both, with no possibility of suspension or commutation of the minimum jail time. For individuals aged 21 and older, soliciting commercial sexual activity will be a felony, punishable by a mandatory minimum of six months in jail, up to three years in jail, or a fine of up to $10,000, or both, also with no possibility of suspension or commutation of the minimum jail time. The bill also declares an emergency and sets an effective date of July 1, 2026.
