This bill amends existing Utah law to broaden the definition of "industrial byproduct" to include coal mine waste and clarifies that "reuse" means using an industrial byproduct as a product in place of a raw material. It also modifies the application process for reusing industrial byproducts, allowing applications for reuse in any "project," which is defined as construction of public infrastructure like roads, walkways, or public transportation facilities, and requires the director to approve applications if the byproduct meets applicable health risk standards for commercial or industrial exposure and passes a toxicity characteristic leaching procedure. Once approved, the reuse of such industrial byproducts is exempt from requirements for human health or ecological risk assessments, site management plans, or environmental covenants, which are legal agreements to restrict land use to protect human health or the environment. The bill also makes a technical change to the definition of "Board" and sets an effective date of May 6, 2026.
