This bill amends the Paid Leave for All Workers Act to clarify who is considered an "employee" for the purposes of paid leave. Specifically, it adds a provision stating that a worker participating in the H-2A temporary agricultural program is not considered an employee under this Act. The H-2A program allows U.S. employers to bring foreign nationals to the United States to fill temporary agricultural jobs for which U.S. non-immigrant workers are not available. This change means that these temporary agricultural workers will not be eligible for paid leave benefits under this Illinois law. The bill takes effect immediately upon becoming law.
